1. Acceptance of Terms

By accessing, browsing, downloading, or utilizing any software, APIs, applications, or digital platforms provided by Tovan Technologies (Pty) Ltd ("the Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms").

These Terms govern your use of all products within the Tovan Technologies ecosystem, including but not limited to proprietary enterprise software and educational platforms such as KATCODE. If you do not agree to these terms, you must immediately cease all use of our products and services.

2. Product Modifications and Functionality

Tovan Technologies operates as a dynamic software engineering firm. We continuously update, refine, and architect new solutions within our ecosystem.

We reserve the absolute right to modify, alter, suspend, deprecate, or completely remove the functionality of any of our products, platforms, or services at any time, without prior notice or liability to you.

This includes, but is not limited to, changing user interfaces, altering core logic, removing specific toolsets, or shutting down legacy applications as we transition to newer architectures.

3. Intellectual Property and Licensing

All software architecture, source code, frontend interfaces, relational database schemas, methodologies, algorithms, and branding elements associated with Tovan Technologies and its products remain the exclusive intellectual property of Tovan Technologies (Pty) Ltd.

• You are granted a limited, non-exclusive, non-transferable license to use our platforms for their intended purpose.
• You may not reproduce, decompile, reverse-engineer, disassemble, or attempt to derive the source code of any Tovan Technologies product.
• Any unauthorized scraping, copying, or replication of our digital infrastructure is strictly prohibited and will result in immediate termination of access and potential legal action.

4. User Accounts and Security

Certain products within our ecosystem may require the creation of a user account. You are solely responsible for safeguarding your authentication credentials.

Tovan Technologies utilizes enterprise-grade security protocols (such as Spring Security filter chains) to protect user data; however, we cannot be held liable for breaches resulting from user negligence, compromised local environments, or shared passwords.

5. Disclaimer of Warranties

All software, platforms, and services provided by Tovan Technologies are provided on an "AS IS" and "AS AVAILABLE" basis.

While we engineer our software to be robust and highly available, we make no explicit warranties that our products will be completely free of bugs, uninterrupted, or perfectly suited to your specific hardware or operational requirements. We disclaim all warranties, whether express or implied, including warranties of merchantability or fitness for a particular purpose.

6. Limitation of Liability

In no event shall Tovan Technologies (Pty) Ltd, its directors, engineers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages-including data loss, revenue loss, or business interruption-arising from your use of, or inability to use, any of our software products or digital platforms.

7. Governing Law

These Terms and your use of all Tovan Technologies products shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from this agreement will be subject to the exclusive jurisdiction of the courts located in the Eastern Cape and KwaZulu-Natal provinces.
